TERMS AND CONDITIONS OF HAIRDRESSING SERVICES
AT HOLLYWOOD HAIR SALONS
OPERATED BY KLAUDIA DUSZYŃSKA
§ 1
GENERAL PROVISIONS
1. These Terms and Conditions define the rights and obligations of individuals using hairdressing services, including hair extension and thickening services provided at Hollywood Hair Salons operated by Klaudia Duszyńska, conducting business under the name Hollywood Hair Klaudia Duszyńska, at the address: ul. Belwederska 40/3, 00-594 Warsaw, NIP: 5060093284, REGON 147365472.
2. The terms used in these Terms and Conditions shall mean respectively:
(a) Agreement – an agreement together with its appendices, based on which the Service Provider renders hairdressing services to Clients, including hair extension and thickening services. These Terms and Conditions form an integral part of the Agreement,
(b) Service Provider - Klaudia Duszyńska, conducting business under the name Hollywood Hair Klaudia Duszyńska, at the address: ul. Belwederska 40/3, 00-594 Warsaw, NIP: 5060093284, REGON 147365472.
(c) Client - a natural person who is at least 18 years old and has full legal capacity, or a minor who is at least 13 years old and is not completely incapacitated, and who uses the services provided at HH Salons with the written consent of a legal guardian,
(d) HH Salon – means a Hollywood Hair hairdressing salon operated by the Service Provider within the network of Hollywood Hair salons, whose addresses are available on the Website,
(e) Website - the website operated by the Service Provider, available at: https://hollywoodhair.pl/.
3. To exercise the rights specified in these Terms and Conditions, the Client may contact the Service Provider via traditional mail at: ul. Belwederska 44, 00-594 Warsaw, via email at: kontakt@hollywoodhair.pl, or by phone at 578 903 292.
4. The addresses of Hollywood Hair Salons and information about HH Salons' opening hours are available on the Website.
5. HH Salons provide hairdressing services, including in particular hair extension and thickening treatments, hair care treatments, hair coloring, and styling. Depending on the HH Salon's location, the range of services offered may vary. A detailed offer of hairdressing services provided at individual HH Salons is available on the Website.
6. These Terms and Conditions are made available to Clients free of charge via the Website in a format that allows this document to be downloaded, saved to a data carrier, stored in any way, including printed. These Terms and Conditions are also made available to the Client in each HH Salon before the service is performed and the Agreement is concluded.
§ 2
RULES FOR PROVIDING SERVICES
1. Services at HH Salon may be used by adults with full legal capacity.
2. Minors who are at least 13 years old and are not completely incapacitated may use the services provided at HH Salons with the written consent of their legal guardians. The declaration form is available at each HH Salon and also constitutes Appendix No. 1 to these Terms and Conditions.
3. In the absence of the written consent of the legal guardian referred to in paragraph 2 above, the Service Provider is entitled to refuse to conclude the Agreement and perform the service.
4. The performance of a service at HH Salon is preceded by a consultation including:
(a) presenting the Client with the Agreement together with its appendices to familiarize themselves with its content and the terms of service,
(b) discussing the Client's expectations and the achievable results of the service (for the Client),
(c) explaining the technique and method of performing the service, and the duration of the achieved result, and in the case of hair extension services, the need to adjust and replenish the extended hair strands,
(d) discussing contraindications to the service, and in the case of hair extension services, circumstances preventing the hair extension procedure and possible side effects of hair extension, which may or may not occur,
(e) discussing the rules of conduct after the service, including the rules of care and styling, especially for extended hair, necessary to achieve the desired effects of the service.
5. Before commencing the service at HH Salon, the Client selects hair strands from the offer available at the Salon, according to personal preferences. The service is performed after the Client accepts the type and weight of the chosen hair strands, the chosen color, their structure, thickness, brittleness, and dryness, including their potential tendency to curl or not, and accepts the remuneration due for the service (cost of hair strands and payment for the service).
6. Detailed information on contraindications to the service and possible side effects of hair extension, which may or may not occur, rules of conduct after the service, including rules of care and styling, especially for extended hair, regardless of providing the Client with the above information before the service at HH Salon, are an appendix to the hair extension service Agreement and are available on the Website.
7. As part of the hair extension and thickening services provided, the Service Provider offers new Clients the possibility of a free consultation before the hair extension service and the possibility for the HH Salon Client to have a follow-up visit at HH Salon.
8. The free consultation service is dedicated to new Clients using HH Salon's services for the first time and includes a free consultation to explain the technique and method of performing hair extension and thickening services, inform about the duration of the achieved result, the need to adjust and replenish extended hair strands, information about contraindications, side effects, and rules of hair care and styling. Paragraph 4 above applies accordingly to the free consultation. An HH Salon Client may use the free consultation service once. The booking rules described in § 3 below apply accordingly to booking this service.
9. As part of the follow-up visit, the Service Provider offers Clients who have previously used hair extension or thickening services at HH Salon, support and assistance in case of doubts regarding the rules for using hair strands, their care and styling, re-attaching hair strands that fall out despite the Client adhering to care and styling rules, repositioning hair strands that cause discomfort to the Client. The booking rules described in § 3 above apply accordingly to booking follow-up visits.
10. The Client using HH Salon's services is obliged to:
(a) familiarize themselves with the content of these Terms and Conditions and adhere to its provisions and the instructions of the Service Provider and HH Salon staff,
(b) book appointments at HH Salon in accordance with the rules described in § 3 of these Terms and Conditions,
(c) inform the Service Provider about contraindications to the service and other circumstances related to the Client's health, the condition of natural hair, and the condition of the scalp that prevent the service or may affect its result,
(d) adhere to accepted social norms, good behavior, and respect towards other individuals present in HH Salon, particularly by not disturbing others' ability to use HH Salon's services.
10. The following are strictly prohibited on HH Salon premises:
(a) smoking tobacco or e-cigarettes,
(b) possessing and consuming alcohol and intoxicating substances and drugs,
(c) arriving for appointments under the influence of alcohol, intoxicated, or under the influence of drugs,
(d) recording images and sound without the prior consent of the Service Provider,
11. The Client is obliged to arrive on time for the booked appointment. In case of a delay exceeding 45 minutes, the Service Provider is entitled to refuse to perform the service. Such a delay will be treated as failure to cancel the appointment within the timeframe referred to in § 3 para. 8 with the consequences indicated in § 3 para. 11.
12. The Service Provider, with the Client's prior consent, may record the service process and the condition of the Client's hair before and after the service using image and sound recording devices, under the terms agreed upon by the Parties in a separate document.
§ 3
APPOINTMENT BOOKINGS
1. HH Salons operate on an appointment-only basis. Clients can book an appointment at HH Salon in the following ways:
(a) in person at the selected HH Salon,
(b) by phone at: 578-903-292,
(c) electronically to the email address: kontakt@hollywoodhair.pl,
(d) electronically via the contact form available on the Website,
(e) electronically by sending a private message via the Service Provider's profile on Facebook and Instagram under the name "Hollywood Hair",
(f) electronically via the Hollywood Hair application provided by the Service Provider.
2. When booking an appointment, the Client is obliged to provide their first and last name and a current phone number. Providing incomplete or false data may result in the cancellation of the appointment. For electronic bookings, the Service Provider will inform the Client about available appointment dates in response to the message sent.
3. The Service Provider may charge a deposit of PLN 300.00 for the implementation of services including hair extension, thickening, or adjustment at HH Salon from Clients using HH Salon's services for the first time or in other justified cases about which the Client will be informed before booking the service.
4. The deposit can be paid in cash or by cashless transfer at the HH Salon where the service is to be performed. In the case of cashless payment, the payment is made via instant transfer or using the "BLIK" mobile payment system.
5. For bookings made by phone or electronically, deposit payments are made by bank transfer to the Service Provider's bank account or by using the form allowing payment of the deposit available on the Website in the "Shop" tab.
6. The Service Provider will inform the Client about the correct bank account number for the deposit by email to the address provided by the Client or via SMS to the phone number provided by the Client, depending on the Parties' arrangements. In such a case, the deposit should be paid within 2 business days of booking. When making a bank transfer, the Client is obliged to include: first and last name, planned appointment date, and the note "deposit" in the transfer details. In case of using the form available on the Website for deposit payment, the provisions of the Hollywood Hair online shop Terms and Conditions available on the Website apply accordingly.
7. In the absence of deposit payment in accordance with the provisions of this paragraph, the Service Provider is entitled to cancel the appointment booked by the Client.
8. The Client may change the date or cancel a booked appointment free of charge no later than 24 hours before the booked appointment. In case of a no-show or complete resignation from Hollywood Hair services, the paid deposit will be forfeited.
9. The Service Provider reserves the right to confirm the booked appointment by phone or SMS sent to the number provided by the Client during the appointment booking, on the day preceding the booked appointment. In the absence of confirmation of presence for the scheduled appointment, the Service Provider is entitled to cancel the appointment booked by the Client.
10. In the event of the Agreement's performance, the deposit referred to in paragraph 3 will be credited towards the remuneration due to the Service Provider for performing the service in accordance with the concluded Agreement.
11. The Service Provider is entitled to retain the deposit referred to in paragraph 3 in the event of:
(a) the Client failing to appear for the scheduled appointment without prior notification to the Service Provider no later than 24 hours before the booked appointment at HH Salon,
(b) cancellation of the scheduled appointment less than 24 hours before its scheduled time,
(c) non-performance of the service due to reasons attributable to the Client (e.g., delay of more than 45 minutes for the scheduled appointment).
§ 4
PRICE LIST. PAYMENTS
1. The amount of fees for using the services provided at HH Salons is determined by the price list, which is Appendix No. 2 to these Regulations. The price list is available in each HH Salon and on the Website.
2. The Service Provider may introduce periodic promotions, gift vouchers, and grant discounts to Clients. Promotions and discounts cannot be combined. Information on the rules and periods of validity of the above-mentioned promotional campaigns will be regulated in separate regulations.
3. The following payment methods for services are available at HH Salon:
(a) in cash at HH Salon,
(b) cashless,
(c) cashless using the PayU installment system.
4. In the case of cashless payment, the payment is made via instant transfer or using the "BLIK" mobile payment system. When making a bank transfer, the Client is obliged to include: first and last name and the date of service performance in the transfer details.
5. In the case of payment using the PayU installment system, the Service Provider will commence the service after the Service Provider's bank account is credited with funds from the credit granted to the Client, corresponding to the amount of fees for the selected service. In the case of payment using the PayU installment system, the provisions of the PayU installment service Regulations available on the Website apply accordingly. The Service Provider informs that, in accordance with the above-mentioned PayU installment service Regulations, in the event of withdrawal from the installment loan agreement, the Client is obliged to pay a commission fee of 5% of the granted installment loan amount.
§ 5
COMPLAINTS
Due to the nature of the services provided by the Contractor, the Client should report a complaint immediately upon noticing irregularities justifying its submission.
1. The Contractor is responsible for the non-performance or improper performance of services provided at HH Salons in accordance with generally applicable law.
2. All complaints regarding services provided at HH Salons may be submitted by the Client:
(a) in writing by leaving the letter at the HH Salon where the service was performed,
(b) by post (registered mail) to the address of the HH Salon where the service was performed,
(c) by post (registered mail) to the following address: ul. Belwederska 44, 00-594 Warsaw
(d) via email to the address: reklamacje@hollywoodhair.pl
3. The Client's complaint submission should contain the Client's first and last name, a description of the issue (with photographs illustrating the condition of the hair), any demands of the Client, and the Client's contact details to which the Service Provider should send a response.
4. The Service Provider reserves that, in order to fairly address the complaint submission, the Client may be asked to come to the HH Salon to inspect the condition of the Client's hair strands and verify the causes of the reported irregularities.
5. The response to the complaint submission will be provided in writing to the indicated correspondence address or electronically to the indicated email address within 14 days from the date of its receipt.
6. After the complaint procedure is completed, the Client may use the following out-of-court methods of complaint resolution and claim assertion:
(a) contact the provincial inspector of the Trade Inspection with a request to initiate proceedings for out-of-court dispute resolution,
(b) refer the matter to the permanent arbitration court at the provincial inspector of the Trade Inspection,
(c) contact a municipal or district consumer ombudsman or a social organization whose statutory tasks include consumer protection, e.g., the Consumers' Federation.
7. Additional information on the possibility for a Client who is a Consumer to use out-of-court methods of complaint resolution and claim assertion is available on the website of the Office of Competition and Consumer Protection at: https://www.polubowne.uokik.gov.pl/. Furthermore, at: http://ec.europa.eu/consumers/odr, an online dispute resolution system platform is available for disputes between consumers and entrepreneurs at the EU level (ODR platform). The ODR platform is an interactive website through which a consumer can submit their complaint regarding contractual obligations arising from an online sales contract or a service contract concluded between consumers residing in the EU and entrepreneurs based in the EU.
8. The use of the above methods of complaint resolution and claim assertion is voluntary, which means that both parties must agree to such a procedure.
§ 6
PERSONAL DATA
1. The Administrator of Clients' personal data is Klaudia Duszyńska, conducting business
activity under the name Hollywood Hair Klaudia Duszyńska at: ul. Belwederska 40/3, 00-594
Warsaw, NIP: 5060093284, REGON 147365472. (hereinafter
referred to as: "Administrator").
2. Personal data will be processed by the Administrator for the following purposes:
(a) conclusion and execution of the Agreement - legal basis: Article 6(1)(b)
of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27
April 2016 on the protection of natural persons with regard to the processing of personal
data and on the free movement of such data, and repealing Directive 95/46/EC (General Data
Protection Regulation) ("GDPR"). Processing is necessary for the performance of the Agreement or
to take steps at the request of the data subject prior to entering into the
Agreement. Processing period: personal data will be processed for the period
necessary to conclude and implement the Agreement;
(b) conducting communication with the Client in matters related to the performance of the
Agreement and in matters related to the Client making a reservation for a visit to the HH Salon,
confirming the Client's reserved visit to the HH Salon, handling complaints - legal basis:
Article 6(1)(f) of the GDPR. Processing is necessary for the purposes of the legitimate
interests pursued by the Administrator concerning the pursuit of providing the highest quality of
services, managing visit reservations and confirming scheduled visits to HH Salons, conducting
communication and resolving matters covered by correspondence addressed to the Administrator,
and handling complaints addressed to the Administrator. Processing period: personal data will be
processed until such matters are concluded, unless in a specific case it will be necessary to store
them until the expiry of claims;
(c) ensuring the safety of persons and property, as well as maintaining order on the premises of
the HH Salon - legal basis: Article 6(1)(f) of the GDPR. Processing is necessary for the purposes
of the legitimate interests pursued by the Administrator concerning the need to ensure order and
safety of persons and property and, possibly, for the purpose of defense against claims directed
against the Administrator or establishing and pursuing claims by the Administrator. Data is
processed for the period necessary to achieve this purpose, with data processed in connection with
video monitoring, if applied, being processed for a period of 3 months from the date of recording,
and then permanently deleted; provided that if image recordings constitute evidence in proceedings
or the Administrator became aware that they may constitute evidence in proceedings - then the
period is extended until the final conclusion of these proceedings or the expiry of claims;
(d) fulfilling legal obligations incumbent on the Administrator, including documenting the provision
of services for tax purposes, performing statistical obligations, maintaining accounting and tax
documentation - legal basis: Article 6(1)(c) of the GDPR. Processing is necessary for compliance
with legal obligations to which the Administrator is subject. Processing period: personal data will
be processed for the period required by law;
(e) pursuing claims and defending against claims - legal basis: Article 6(1)(f) of the GDPR.
Processing is necessary for the purposes of the legitimate interests pursued by the Administrator
concerning the pursuit of legal protection. Processing period - the statute of limitations for claims.
3. Providing the Client's identification data is necessary for the conclusion and performance of the
Agreement. In case of refusal to provide this data, the Agreement cannot be concluded or performed.
4. Only authorized employees of the Administrator and entities cooperating with the Administrator,
with whom appropriate agreements have been concluded, have direct access to the Client's personal
data. This applies to companies providing services to the Administrator, e.g., companies providing IT
support services and supplying software or IT services, companies providing accounting and legal
services, companies providing postal and courier services.
5. The Administrator does not transfer Client data outside the European Economic Area (comprising
the European Union, Norway, Liechtenstein, and Iceland).
6. The Client has the following rights related to data processing:
(a) the right to access their data,
(b) the right to rectify their data,
(c) the right to request the erasure of data,
(d) the right to request restriction of data processing,
(e) the right to data portability.
7. The Client has the right to lodge a complaint with the supervisory authority - the President of the
Personal Data Protection Office (address: ul. Stawki 2, 00-193 Warsaw).
8. The Client's personal data is not subject to profiling, or similar decision-making based solely on
automated processing.
§ 7
Final Provisions
1. The Service Provider informs that video monitoring is installed on the premises of HH Salons,
and the monitored areas are appropriately marked. Data from monitoring is processed for the
purposes and on the principles described in § 6 above.
2. By leaving items in the HH Salon, the Client does not conclude a storage contract or any other
agreement obliging the Service Provider to take custody of these items.
3. The Service Provider reserves the right to make changes to these Regulations, with the proviso
that for Clients who booked a visit to the HH Salon or concluded an Agreement before the date of
such changes, the Regulations in force on the date of the respective booking of a visit to the HH
Salon or conclusion of the Agreement shall apply.
4. The Service Provider will inform Clients about changes to the Regulations by publishing the
amended content of the Regulations on the Website and by making the Regulations available in the
HH Salon.
5. Changes to the provisions of the Regulations may be introduced only for important reasons, i.e.,
in the event of:
(a) changes to the Service Provider's data (e.g., address details, website address, email address,
phone number),
(b) changes to the rules for using services provided in HH Salons, including changes to the price list,
(c) changes to IT systems or technical or technological solutions used by the Service Provider,
especially concerning payment mechanisms to which the provisions of the Regulations apply,
(d) changes in generally applicable legal provisions or when the need for change results from a final
administrative decision or a final court judgment, as well as from guidelines, orders, recommendations,
interpretations, or recommendations of authorized bodies, including the Office of Competition and
Consumer Protection,
(e) the need to introduce editorial and organizational changes.
6. If any of the provisions of these Regulations turns out to be invalid or legally ineffective, this does not
affect the validity and effectiveness of the remaining provisions of the Regulations.
